Interpretation means the art of finding out the true sense of an enactment by giving the words of the enactment their natural and ordinary meaning. It is the process of ascertaining the true meaning of the words used in a statute Kind of interpretation Grammatical interpretation grammatical or strict interpretation means sense conveyed by the actual words Logical interpretation logical interpretation means look behind the actual word, used to assumed intention of the Legislature General rules of interpretation As a general rule the courts are bound by the literal words of a statue it is only in exceptional case of ambiguity, uncertainty or incomplete meaning of the Statue, that rule of liberal interpretation is to be applied. The Cardinal rule of the interpretation of an act of parliament is that they should be construed according to the literal meaning conveyed by them The court has framed certain general rules for accepting ascertaining the literal meaning of the words used in a statue. Some of these rules are as under 1 The golden rule of interpretation is that the word of the statues must be given their ordinary meaning that is to say so long as the meaning of the statue is clear certain and unambiguous judges should not apply their opinion to modify the meaning of the words used in statue 2 Yet another important rule of interpretation is that a statue must be read as a whole in order to give effect to the intention of the former of it. The court must look to the object which the whole statue seeks to achieve while interpreting any of the provisions of the act 3 It is not competent for any Court to proceed on the assumption that the legislature has made a mistake the court must precede on the footing that the legislature intended what is had said even if there is some defect in the phrases used by the Legislature the court cannot aid the legislature is defective 4 for the sure and true interpretation of all statues in general whether they are penal are beneficial ,restrictive or enlarging of the common law four things are to be discussed and considered i what was the common law before the making of the Act ii what was the Mischief and that affect for which the common law did not provide iii what remedy the Parliament has resolved and appointed to cure the wrong iv reason of the remedy I am the student of Law and this is my channel which is all about Law. What is LAW OF IDENTITY? What does LAW OF IDENTITY mean? LAW OF IDENTITY meaning & explanation

02:17
What is LAW OF IDENTITY? What does LAW OF IDENTITY mean? LAW OF IDENTITY meaning - LAW OF IDENTITY definition - LAW OF IDENTITY explanation. Source: Wikipedia.org article, adapted under https://creativecommons.org/licenses/by-sa/3.0/ license. In logic, the law of identity is the first of the three classical laws of thought. It states that "each thing is the same with itself and different from another". By this it is meant that each thing (be it a universal or a particular) is composed of its own unique set of characteristic qualities or features, which the ancient Greeks called its essence. Consequently, things that have the same essence are the same thing, while things that have different essences are different things. In its symbolic representation, "A is A", the first element of the proposition represents the subject (thing) and the second element represents the predicate (its essence), with the copula "is" signifying the relation of "identity". Further, since a definition is an expression of the essence of that thing with which the linguistic term is associated, it follows that it is through its definition that the identity of a thing is established. For example, in the definitive proposition:"A lawyer is a person qualified and authorized to practice law", the subject (lawyer) and the predicate (person qualified and authorized to practice law) are declared to be one and the same thing (identical). Consequently, the Law of Identity prohibits us from rightfully calling anything other than "a person qualified and authorized to practice law" a "lawyer". In logical discourse, violations of the Law of Identity (LOI) result in the informal logical fallacy known as equivocation. That is to say, we cannot use the same term in the same discourse while having it signify different senses or meanings – even though the different meanings are conventionally prescribed to that term. In everyday language, violations of the LOI introduce ambiguity into the discourse, making it difficult to form an interpretation at the desired level of specificity.

The Law Of Attraction - How It Really Works & How To Use It

13:00
The Law Of Attraction -- Learn how it actually works without the New Age mumbo-jumbo, and how to use it to create amazing results. The Ultimate Life Purpose Course - Create Your Dream Career: http://www.actualized.org/life-purpose-course Leo's Top 140 Self Help Books http://www.actualized.org/books Full Video Transcript Here: http://www.actualized.org/articles/law-of-attraction Video Summary: Simply, the Law of Attraction states that you attract that on which you most focus. The obvious corollary to the Law of Attraction is the advice to focus on the things you want more of in your life – that you should spend more time thinking about what you wish to attract into your life than what you don't like. Unfortunately, most people do the opposite, always worrying and obsessing about their problems. While that's human nature, it needn't be yours. If you want things in your life to get better, focus on the solution, not on the problem. Your thoughts generate the action you take in your life. If your thoughts are soaked in negativity, your action can't be resourceful. Instead of focusing on the elimination of a problem, focus on what you can create instead. Replace worrying with the projection of positive images. The Law of Attraction is extremely powerful because it works on the subconscious. Once your subconscious starts to resonate with your new-found feeling of confidence, joy, and calmness, it stops resisting. You'll struggle less, shed your fear, and be bolder and more persistent in pursuit of your goals.

What is COMMON LAW? What does COMMON LAW mean? COMMON LAW meaning, definition & explanation

02:54
What is COMMON LAW? What does COMMON LAW mean? COMMON LAW meaning - COMMON LAW definition - COMMON LAW explanation. Source: Wikipedia.org article, adapted under https://creativecommons.org/licenses/by-sa/3.0/ license. common law (also known as case law or precedent) is law developed by judges, courts, and similar tribunals, stated in decisions that nominally decide individual cases but that in addition have precedential effect on future cases. Common law is a third branch of law, in contrast to and on equal footing with statutes which are adopted through the legislative process, and regulations which are promulgated by the executive branch. A "common law system" is a legal system that gives great precedential weight to common law, so that consistent principles applied to similar facts yield similar outcomes. The body of past common law binds judges that make future decisions, just as any other law does, to ensure consistent treatment. In cases where the parties disagree on what the law is, a common law court looks to past precedential decisions of relevant courts. If a similar dispute has been resolved in the past, the court is usually bound to follow the reasoning used in the prior decision (this principle is known as stare decisis). If, however, the court finds that the current dispute is fundamentally distinct from all previous cases (called a "matter of first impression"), judges have the authority and duty to make law by creating precedent. Thereafter, the new decision becomes precedent, and will bind future courts. Stare decisis, the principle that cases should be decided according to consistent principled rules so that similar facts will yield similar results, lies at the heart of all common law systems. One third of the world's population live in common law jurisdictions or in systems mixed with civil law. Common law originated during the Middle Ages in England, and from there was propagated to the colonies of the British Empire, including India, the United States (both the federal system and 49 of its 50 states), Pakistan, Nigeria, Bangladesh, Canada (and all its provinces except Quebec), Malaysia, Ghana, Australia, Sri Lanka, Hong Kong, Singapore, Burma, Ireland, New Zealand, Papua New Guinea, Jamaica, Trinidad and Tobago, Cyprus, Barbados, South Africa, Zimbabwe, Cameroon, Namibia, Liberia, Sierra Leone, Botswana, Guyana, and Fiji.

The First Principles Method Explained by Elon Musk

02:49
Interview by Kevin Rose The benefit of "first principles" thinking? It allows you to innovate in clear leaps, rather than building small improvements onto something that already exists. Musk gives an example of the first automobile. While everyone else was trying to improve horse-drawn carriages, someone looked at the fundamentals of transportation and the combustion engine in order to create a car. Naturally Musk does give one warning about using first principles for innovating however, "it takes a lot more mental energy."

ARCHIMEDES' PRINCIPLE or LAW of FLOATATION and BUOYANT FORCE | in HINDI

16:19
In this Physics video lecture for class 11 we explained Archimedes' principle known as law of floatation and buoyant force or force of buoyancy. We also derived the equation for floating bodies. During the derivation of the formula we found that the apparent weight for a submerged object in a fluid is the product of the volume of the object, the acceleration due to gravity and the difference in the densities of the object and the fluid. Archimedes’ principle : It states that any body completely or partially submerged in a fluid (gas or liquid) at rest is acted upon by an upward, or buoyant, force the magnitude of which is equal to the weight of the fluid displaced by the body. ★★★★★★★★★★★★★★★★ Click to visit the homepage of our channel : https://www.youtube.com/channel/UCG1-22fo1sIhXGuXYpTRqaA Arijit Daripa EduPoint, Dam Road, Chandil, Dist- Seraikela-Kharsawan, Jharkhand, India.

Speaker 3: Eckart Brödermann Principles Familiar to Civil Law, Unfamiliar to Common Law Tradition • Knock-Out Doctrine • Pre-contractual conduct in contract interpretation • Course of performance in contract interpretation • Duty of Good Faith in contract negotiations UNIDROIT PRINCIPLES OF INTERNATIONAL COMMERCIAL CONTRACTS On 25 February 2015, a two-hour program, The 2010 UNIDROIT Principles of International Commercial Contracts, took place in six video-linked locations: New York, London, Paris, Berlin, Frankfurt, andWashington D.C. The event, an initiative of the New York Branch of the Chartered Institute of Arbitrators (CIArb NY Branch), was organized and hosted by Squire Patton Boggs, and co-sponsored by ICC/SICANA, Inc., the New York International Arbitration Center (NYIAC), the College of Commercial Arbitrators (CCA), and the CIArb European Branch and Washington D.C. Chapter. Six prominent academics active in the UNIDROIT Principles Working Group made presentations on specific topics and answered questions from an audience sophisticated in international commercial law and dispute resolution. The event provided an occasion for a lively introduction to key provisions of the UNIDROIT Principles, to their actual and potential use in cross-border commercial contracts, and to their influence in the evolution of commercial law in civil, common law and developing legal systems. The program was introduced by Peter Michaelson (independent arbitrator and chair of CIArb New York Branch), and moderated by Richard Mattiaccio (Squire Patton Boggs (US) LLP partner, chair of the CIArb New York Branch Programming Committee, CCA Fellow, NYIAC director, and UNIDROIT Principles Working Group observer.)

What is RULE OF LAW? What does RULE OF LAW mean? RULE OF LAW meaning & explanation

01:43
What is RULE OF LAW? What does RULE OF LAW mean? RULE OF LAW meaning - RULE OF LAW definition - RULE OF LAW explanation. Source: Wikipedia.org article, adapted under https://creativecommons.org/licenses/by-sa/3.0/ license. The rule of law is the legal principle that law should govern a nation, as opposed to being governed by arbitrary decisions of individual government officials. It primarily refers to the influence and authority of law within society, particularly as a constraint upon behaviour, including behaviour of government officials. The phrase can be traced back to 16th century Britain, and in the following century the Scottish theologian Samuel Rutherford used the phrase in his argument against the divine right of kings. The rule of law was further popularized in the 19th century by British jurist A. V. Dicey. The concept, if not the phrase, was familiar to ancient philosophers such as Aristotle, who wrote "Law should govern". Rule of law implies that every citizen is subject to the law, including law makers themselves. In this sense, it stands in contrast to an autocracy, dictatorship, or oligarchy where the rulers are held above the law. Lack of the rule of law can be found in both democracies and dictatorships, for example because of neglect or ignorance of the law, and the rule of law is more apt to decay if a government has insufficient corrective mechanisms for restoring it. Government based upon the rule of law is called nomocracy.

This means that if pressure is applied at one point in a liquid kept in a container, all the surfaces of the liquid exert the same amount of pressure on the walls of the container. Pascal's Law Formula: ΔP = ρgΔh Hydraulic Brake System Hydraulic types of brakes are very efficient and long lasting, as a fluid is used to transmit the pressure applied on the brakes to the wheels, and the elasticity of fluids doesn't get lost over time, thus these brakes are better than the common breaks used in vehicles. What is CONSTITUTIONAL LAW? What does CONSTITUTIONAL LAW mean? CONSTITUTIONAL LAW meaning

01:34
What is CONSTITUTIONAL LAW? What does CONSTITUTIONAL LAW mean? CONSTITUTIONAL LAW meaning. Constitutional law is the body of law which defines the relationship of different entities within a state, namely, the executive, the legislature, and the judiciary. Not all nation states have codified constitutions, though all such states have a jus commune, or law of the land, that may consist of a variety of imperative and consensual rules. These may include customary law, conventions, statutory law, judge-made law, or international rules and norms. Constitutional law deals with the fundamental principles by which the government exercises its authority. In some instances, these principles grant specific powers to the government, such as the power to tax and spend for the welfare of the population. Other times, constitutional principles act to place limits on what the government can do, such as prohibiting the arrest of an individual without sufficient cause. In most nations, including the United States, constitutional law is based on the text of a document ratified at the time the nation came into being.

Natural Law Theory: Crash Course Philosophy #34

09:39
Our exploration of ethical theories continues with another theistic answer to the grounding problem: natural law theory. Thomas Aquinas’s version of this theory says that we all seek out what’s known as the basic goods and argued that instinct and reason come together to point us to the natural law. There are, of course, objections to this theory – in particular, the is-ought problem advanced by David Hume. The 48 Laws of Power (Animated)

29:19
Get 2 FREE Audiobooks of Your Choice on Audible | http://amzn.to/2b9GBJr I crafted this summary of the 48 Laws of Power in anger. It is the end result of 2 years of animating all chapters condensed for your viewing pleasure. Surely, you've heard the phrase "Hate the game, not the player." I'm exposing the game and the players for you. Being honest and speaking the truth has been a punishing and not at all rewarding experience, since most people will always shoot the messenger. I aim to raise awareness and arm the clueless for self-protection. I am not advocating becoming a manipulating and ruthless sociopath. I can't respect those who don't understand the difference. It's a self-improvement book, not the work of the devil. Robert Greene is all about intense realism. Seeing things for what they are, whether you like the truth or not. Hopefully you'll find the video helpful, learn from it and share it with others. I've received plenty of messages from good people claiming it changed their lives for the better. Don't let others use and abuse you. Don't live in a fantasy land. Be cautious. Read this book or don't. It's up to you. ___ Subscribe 💪 http://bit.ly/illacertus Buy "The 48 Laws of Power" in the USA - http://amzn.to/1SRVIXS Buy "The 48 Laws of Power" in CA - http://amzn.to/1T2xKbd Buy "The 48 Laws of Power" in the UK - http://amzn.to/1q3UkpB ___ Music | Ross Bugden ___ Watch my "11 Powerful Laws" collaboration with Improvement Pill - https://www.youtube.com/watch?v=7NkgtU3Lj8M

Newton's Laws: Crash Course Physics #5

I'm sure you've heard of Isaac Newton and maybe of some of his laws. Like, that thing about "equal and opposite reactions" and such. But what do his laws mean? And how do they help us understand the world around us? In this episode of Crash Course Physics, Shini talks to us about just that. *** Produced in collaboration with PBS Digital Studios: http://youtube.com/pbsdigitalstudios Help PBSDS win a Webby Award by voting here: https://pv.webbyawards.com/2016/online-film-video/video-channels-and-networks/science-education Crash Course is on Patreon! Newton's First Law of Motion - Class 9 Tutorial

05:21
Newton's first law of motion states that: An object at rest stays at rest and an object in motion stays in motion with the same speed and in the same direction unless acted upon by an unbalanced force. This law is really only a definition of force. It says that when a body is acted upon by an external resultant force it will accelerate. An object resting will remain at rest, permanently, so long as nothing pushes or even pulls onto it. An object within motion will remain in motion, driving a straight line, eternally, till something forces or even pulls onto it.
